Client Responsibilities After Case Is Filed

The precise path you take determines how extensive your responsibilities after filing will be, and we are diligent in working with Chapter 7, Chapter 13, and Chapter 11 bankruptcy filers. Across the board, however, one of the most important responsibilities you will have is to keep making payments on secured assets you are trying to keep—including mortgage payments and car payments— even if you do not receive billing statements.

When we need something from you, you will be contacted right away. Your active participation in your case and timely response to our requests for information or documents is not only expected but is an integral part of the success of your bankruptcy case.

In all personal bankruptcy filings you are required to complete a debtor education course as soon as your case is filed. Each chapter also has its individual requirements, such as:

Chapter 7 bankruptcy — You need to provide bank statements covering the date of filing for all bank accounts as quickly as possible.

Chapter 13 bankruptcy

  • Make your first plan payment within 30 days of filing and send all subsequent payments on time
  • Be diligent in keeping records of your mortgage, car and trustee plan payments for the entire duration of your case
  • Comply with all requests from your bankruptcy trustee and our office
  • Inform us right away of any changes in your financial situation that may impact your ability to make plan payments or meet other obligations
